Ira Leesfield, a prominent personal injury lawyer in Florida, is also an active member of his professional community and currently acts as Chair of the Resort Tort Litigation Group of the American Association for Justice (AAJ). A multi-faceted organization, the AAJ began more than 60 years ago with the aim of strengthening the legal system as a whole. In addition to helping attorneys through the AAJ Exchange, the AAJ facilitates a supportive network of legal professionals through a broad catalogue of litigation groups in which lawyers may share expertise and exchange information about highly specific types of cases. A large percentage of the legal professional population utilizes AAJ for insight into specific areas of law. AAJ features 18 sections of law; each of these contains successful trial techniques and helpful methods. While countless lawyers utilize AAJ for its wealth of online information, many also seek to improve their roles through AAJ conventions, events in which participants may earn one year’s worth of Continuing Legal Education credit and participate in beneficial dialogues with their peers. Resort torts are an important part of our practice at Leesfield & Partners, involving civil liability in cases of negligent or intentional acts that occur at resorts and other recreational settings. The wide range of issues involved in resort torts includes hotel and motel safety; leisure boating, jet skiing, swimming, and other aquatic incidents; aviation accidents; cruise ship injuries; rental car liability; and amusement park and casino liability. What ties these diverse areas of practice together is that they frequently involve travelers and tourists. At Leesfield & Partners, we strive to assist those involved in resort incidents, ensuring adequate means of legal redress for them in the cases of proprietor negligence or fault. Cases that we commonly pursue involve premises liability, slip and fall liability, and lighting and illumination issues. In these cases, we often utilize evidence of prior incidents to bolster our cases and achieve significant awards. We also represent plaintiffs in numerous medical care cases, in which accidents have occurred in remote locations while the victim is snorkeling, scuba diving, or boating. In particular, we hold resorts and hotels legally responsible for exercising reasonable care in referring individuals to competent, reputable health care providers. Legal Terms Glossary

If the time has come for you to pursue legal action, you may start to hear some terms with which you are unfamiliar. This brief guide can help you to navigate legal jargon and understand your case. A Priori Assumption: An assumption that is without substantiation, proof, or evidence. Abate: To alleviate an issue or problem. Alternative Dispute Resolution: A type of settlement that does not require formal court procedures. Bad Faith: Conscious and intentional deception or breach of commitment; disparate from negligence. Compensatory Damages: Monetary reimbursement for harm to a property or person ordered by a settlement. Deposition: An attorney’s process of obtaining information from the opposing party. Gross Negligence: The act of leaving a duty unfulfilled at the expense of another party’s person or property. Medical Lien: The right of a hospital, doctor or healthcare provider to assert an interest in personal injury recoveries to the extent of the cost of the treatment and/or service provided. Negligent infliction of Emotional Distress: The underlying concept is that one has a legal duty to use reasonable care to avoid causing emotional distress to another individual. If one fails in this duty and unreasonably causes emotional distress to another person, that person will be liable for monetary damages to the injured individual. Personal Injury Protection (PIP): A form of insurance that covers any medical care or costs and settles with the third party’s insurance provider later. Procedure Code (CPT): A number used to track any given individual’s medical care procedures. Punitive Damages: Also referred to as exemplary damages. Refers to the amount awarded to the party who has received damage or harm. Spoliation: The intentional damage or liquidation of evidence. Statute of Limitations: The legal parameter of time following an incident in which an individual is entitled to pursue legal action. Tort: The area of law that treats personal or property damage as the result of another party’s negligence or error. Tortfeasor: The party responsible for damage or injury.
